Terms and Conditions

Please read these Terms and Conditions carefully before enrolling in any coaching program, purchasing any product or using any service offered by One Australia Group. By enrolling, paying or using our services, you agree to be bound by these terms.

1 About One Australia Group

One Australia Group (operating as A One Australia Education Group, ABN as registered in Victoria, Australia) is a private English proficiency coaching institute headquartered at Suite 909, Level 9, 343 Little Collins Street, Melbourne, VIC 3000. We provide coaching services for PTE Academic, IELTS Academic, NAATI CCL, LanguageCert, OET and CELPIP examinations, and operate the MockMaster.ai AI practice platform and the NAATI Ninja mobile application.

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Student", "Client" or "you") and One Australia Group ("we", "us" or "our") in relation to all services, programs, products and digital platforms we offer, whether delivered in-person at our Melbourne campuses or online via Zoom or our digital platforms.

2 Acceptance of Terms

By completing an enrolment form, making a payment, attending a class or session, accessing our digital platforms, or engaging with our services in any way, you confirm that:

  • You have read and understood these Terms in their entirety
  • You agree to be legally bound by these Terms
  • You are at least 18 years of age, or have the express consent of a parent or legal guardian
  • You have the legal capacity to enter into a binding agreement
  • The information you have provided during enrolment is accurate and complete

3 Services Offered

One Australia Group offers the following services, subject to these Terms:

The specific services you receive depend on the coaching plan you have purchased. Details are provided in your enrolment confirmation. One Australia Group reserves the right to modify, suspend or discontinue any service at any time with reasonable notice.

4 Enrolment and Eligibility

4.1 Enrolment

Enrolment is confirmed only upon receipt of full payment. Completion of an enquiry form or verbal confirmation from our team does not constitute a binding enrolment. Your place in a coaching batch is reserved only after your payment has been successfully processed and you have received a written enrolment confirmation from One Australia Group.

4.2 Eligibility

You must have a genuine need to prepare for an English proficiency examination or a related assessment. You agree to provide accurate personal information during enrolment including your full legal name, contact details and current English proficiency level. One Australia Group reserves the right to refuse enrolment at its discretion.

4.3 Batch allocation

Upon enrolment, you will be allocated to a coaching batch based on your preferred study mode, schedule and language (for NAATI CCL). Batch times are subject to availability. One Australia Group will make reasonable efforts to accommodate your preferred schedule but cannot guarantee specific batch times.

4.4 Age requirement

All students must be 18 years of age or older to enrol independently. Students under 18 may enrol with written consent from a parent or legal guardian, who will be jointly bound by these Terms.

5 Fees and Payment

5.1 Fee structure

Coaching fees are published on our website and communicated at the time of enrolment. All fees are in Australian Dollars (AUD) unless otherwise stated. One Australia Group reserves the right to change its fees at any time. Fee changes will not apply to confirmed enrolments unless the student is upgrading their plan.

5.2 Payment methods

  • Credit card and debit card (Visa, Mastercard, American Express)
  • Bank transfer (BSB: 063-000 ยท Account: 1234 5678 ยท Reference: your full name + exam type)
  • Afterpay โ€” 4 fortnightly instalments at no additional cost (subject to Afterpay approval)
  • PayPal

5.3 Afterpay

Afterpay is a third-party payment service. By selecting Afterpay, you agree to Afterpay's own terms and conditions in addition to these Terms. One Australia Group receives full payment from Afterpay at the time of enrolment. Your obligation to complete Afterpay instalments is a separate agreement between you and Afterpay. Failure to complete Afterpay instalments does not entitle you to a suspension or cancellation of your coaching services.

5.4 GST

All coaching fees are inclusive of GST (Goods and Services Tax) where applicable under Australian law.

5.5 Failed payments

If a payment fails, is reversed, or a chargeback is initiated, One Australia Group reserves the right to immediately suspend coaching services until the outstanding amount is resolved. Any costs incurred by One Australia Group in recovering unpaid amounts (including legal fees) may be charged to you.

โš ๏ธ Important: Full payment is required before classes commence. One Australia Group does not offer payment deferrals, credit terms or payment plans outside of the Afterpay arrangement unless expressly agreed in writing by a company director.

6 No Refund Policy

๐Ÿšซ All purchases are final. One Australia Group does not offer refunds under any circumstances once payment has been made.

6.1 No refund โ€” all plans

By completing your payment, you acknowledge and agree that:

  • All coaching fees are non-refundable, regardless of whether classes have commenced
  • You have made an informed, voluntary decision to purchase this coaching program
  • You understand the scope, format and duration of the coaching program you have purchased
  • One Australia Group invests significant resources in preparing your personalised learning plan, scheduling your trainer and allocating your class seat immediately upon receipt of payment
  • A change of mind, personal circumstances, change in visa or immigration plans, exam cancellation or postponement does not entitle you to a refund

6.2 Unused sessions

Unused or missed coaching sessions, mock tests or feedback sessions are non-transferable and have no monetary value. There is no credit, carry-over or refund for sessions not attended.

6.3 Plan upgrades

If you wish to upgrade from one coaching plan to a higher-tier plan, the difference in fee is payable upfront. The original payment is not refunded โ€” it is applied toward the higher plan value at One Australia Group's discretion.

6.4 Exceptional circumstances

In cases of documented serious medical emergency or bereavement (supported by official documentation), One Australia Group may, at its sole discretion, offer a credit toward a future coaching program (not a monetary refund). This is a discretionary goodwill gesture and does not constitute an entitlement. Each case is assessed individually by the Managing Director.

7 Student Conduct

By enrolling in any One Australia Group coaching program, you agree to maintain respectful, professional conduct in all interactions with our trainers, staff and fellow students. The following are not permitted:

  • Disruptive, abusive, threatening or discriminatory behaviour toward trainers or other students, whether in person, via Zoom, WhatsApp or any other communication channel
  • Recording, photographing or distributing any class content, materials, trainer feedback or coaching resources without prior written consent from One Australia Group
  • Sharing login credentials, session links or course materials with any person not enrolled in the program
  • Using course materials for commercial purposes, resale or redistribution without written authorisation
  • Submitting false or misleading information at enrolment or during coaching
  • Any form of academic dishonesty, cheating or misrepresentation in practice assessments

One Australia Group reserves the right to remove any student from a coaching program for conduct that breaches this clause, without refund and without liability.

8 Scheduling, Attendance and Class Changes

8.1 Class schedule

One Australia Group publishes class schedules and batch times at the time of enrolment. While we make every effort to maintain the published schedule, One Australia Group reserves the right to reschedule, merge or cancel classes due to trainer availability, public holidays, low enrolment or other operational requirements. Where a class is cancelled by One Australia Group, a replacement class or recording will be provided.

8.2 Student attendance

Regular attendance is your responsibility. Classes missed by the student are not refunded, rescheduled on an individual basis, or credited. Where a class is recorded, the recording will be made available to enrolled students for a limited period as a substitute, not a supplement, to attending live.

8.3 Public holidays

Classes may not be held on Australian public holidays, particularly in Victoria. One Australia Group will communicate any schedule changes with reasonable advance notice.

8.4 Trainer changes

One Australia Group may substitute trainers without notice due to illness, unavailability or other operational reasons. A change of trainer does not constitute a material change to the service and does not entitle the student to a refund or discount.

8.5 Late arrivals

Students who arrive late to class sessions may not be able to participate in activities already in progress. Late arrival does not entitle the student to a make-up session.

9 Intellectual Property

All content provided by One Australia Group โ€” including but not limited to coaching materials, practice questions, templates, mock tests, score reports, vocabulary lists, audio recordings, video recordings, slides, guides, digital resources and the MockMaster.ai platform โ€” is the exclusive intellectual property of A One Australia Education Group.

  • You are granted a personal, non-exclusive, non-transferable licence to use these materials solely for your own private study purposes during your enrolment period
  • You may not reproduce, copy, share, sell, sublicense, translate, adapt or create derivative works from any of our content without prior written permission
  • Recording of classes, sessions or mock tests is strictly prohibited without written consent
  • Screenshots of materials shared during class sessions may not be distributed externally

Violation of this clause entitles One Australia Group to immediately terminate your enrolment, pursue civil remedies for damages and, where applicable, refer the matter for legal action under Australian copyright law.

10 Privacy and Data

One Australia Group collects, stores and processes personal data in accordance with the Australian Privacy Act 1988 and applicable state legislation. By enrolling, you consent to:

  • Collection of your name, contact details, exam history, mock test results and communication records for the purpose of delivering coaching services
  • Storage of your data in secure systems located in Australia and with reputable third-party service providers (Zoom, Google Workspace, AWS, Stripe, Afterpay)
  • Communication with you via email, WhatsApp, SMS and phone in connection with your coaching program
  • Use of anonymised, aggregated data for internal product improvement and marketing purposes

You have the right to request access to, correction of, or deletion of your personal data at any time. See our Privacy Policy for full details and how to submit a request.

One Australia Group will never sell your personal data to third parties. Your contact information will not be shared with any external party for marketing purposes without your explicit consent.

11 Limitation of Liability

11.1 No guarantee of exam outcomes

While One Australia Group maintains a strong track record and is committed to delivering high-quality coaching, we do not guarantee any specific exam score, band, result or outcome for any student. Exam results depend on many factors outside our control, including the student's effort, attendance, existing proficiency level, exam-day performance and the scoring decisions of the independent examining body (Pearson, IDP/British Council, NAATI, etc.).

11.2 Cap on liability

To the maximum extent permitted by applicable law, One Australia Group's total liability to any student for any claim arising out of or in connection with these Terms or our services shall not exceed the total fees paid by that student for the specific coaching program in question.

11.3 Exclusion of consequential loss

One Australia Group is not liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of visa opportunity, loss of employment, loss of income, immigration delays, university admission rejections or any other consequential loss, even if we had been advised of the possibility of such damages.

11.4 Technology failures

One Australia Group is not liable for interruptions to online coaching services caused by internet outages, platform downtime (Zoom, Google, etc.), power failures, cyberattacks or other technology failures outside our reasonable control. In such cases, we will endeavour to reschedule affected sessions as promptly as practicable.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law (Competition and Consumer Act 2010, Schedule 2), which provides non-excludable guarantees for services supplied to consumers.

12 Warranties and Representations

One Australia Group warrants that:

  • We will deliver coaching services using qualified trainers with relevant expertise in the relevant exam
  • We will provide the services described at the time of your enrolment to a reasonable professional standard
  • Our coaching materials are developed in good faith based on publicly available exam information
  • MockMaster.ai scoring models are calibrated regularly against published official exam criteria

You warrant that:

  • All information provided during enrolment is accurate, complete and not misleading
  • You will engage with the coaching program with genuine commitment and reasonable effort
  • You are enrolling for lawful purposes and your own genuine preparation for an English proficiency exam
  • You will not share, resell or reproduce any One Australia Group coaching materials

13 Third-Party Links and Platforms

Our website and services may contain links to or integrations with third-party platforms including but not limited to Pearson (PTE), IDP/British Council (IELTS), NAATI, Zoom, Afterpay, Stripe, Google, Apple and the App Store and Google Play stores. These platforms are independent of One Australia Group. We do not endorse, control or take responsibility for the content, availability, terms or privacy practices of any third-party platform.

Your use of third-party platforms is governed by the terms of those platforms. One Australia Group accepts no liability for any loss, disruption or damage arising from your use of third-party services.

14 Governing Law and Dispute Resolution

14.1 Governing law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia, and the applicable laws of the Commonwealth of Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria in respect of any dispute arising under or in connection with these Terms.

14.2 Dispute resolution

If you have a complaint or dispute, we encourage you to contact us in the first instance at info@oneaustraliagroup.com or call +61 401 616 524. We are committed to resolving complaints promptly and fairly.

If a dispute cannot be resolved through direct communication, either party may refer the matter to mediation facilitated by an agreed mediator beforecommencing formal legal proceedings. The cost of mediation is shared equally unless otherwise agreed.

14.3 Australian Consumer Law

These Terms do not exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law. If there is any inconsistency between these Terms and the Australian Consumer Law, the Australian Consumer Law prevails to the extent of the inconsistency.

15 Amendments to These Terms

One Australia Group reserves the right to amend, update or replace these Terms at any time. Changes will be published on our website at oneaustraliagroup.com/terms-conditions and the "Effective date" at the top of the document will be updated accordingly.

For students currently enrolled in a coaching program, material changes to these Terms will be communicated via email or WhatsApp at least 14 days before taking effect. Continued use of our services after the effective date of any updated Terms constitutes acceptance of those changes.
